AllergenMaps Terms of Use and User Agreement

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the AllergenMaps website, database, and related services (collectively, the "Service") operated by Allergen Maps LLC, an Indiana limited liability company ("AllergenMaps," "we," "us," or "our").

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Service immediately.

2. Description of the Service

AllergenMaps provides an informational platform that aggregates publicly available data regarding pharmaceutical products and their inactive ingredients (excipients). The Service organizes this information to help users identify potential allergen or sensitivity risks associated with excipients.

Examples of excipient categories that may be analyzed include:

  • Gluten or wheat-derived ingredients
  • Alpha-gal related materials
  • Lactose or dairy-derived ingredients
  • Corn-derived excipients
  • Alcohols and solvents
  • Dyes and color additives
  • Polymers and other excipient classes

The Service is intended solely as an informational reference tool.

3. No Medical Advice

All information provided by the Service is for informational and educational purposes only.

The Service does not:

  • Provide medical advice
  • Diagnose medical conditions
  • Recommend treatments
  • Replace professional medical consultation

Healthcare professionals should always rely on independent clinical judgment and official drug information sources. Patients should consult licensed healthcare professionals before making medication decisions.

4. Clinical Decision Support Disclaimer

The Service may assist users by organizing medication excipient information. However, it is not intended to function as an autonomous clinical decision support system.

Healthcare providers must independently verify information and exercise professional judgment when evaluating medication safety.

5. Data Accuracy and Limitations

AllergenMaps attempts to provide accurate and up-to-date information regarding medication excipients. However, pharmaceutical manufacturing and ingredient sourcing involve complex supply chains.

Limitations include:

  • Variations between manufacturers
  • Changes in formulation over time
  • Multiple potential ingredient sources
  • Undisclosed processing agents
  • Possible manufacturing cross-contamination

Because of these limitations, AllergenMaps cannot guarantee the completeness or accuracy of all information presented.

6. Allergen Risk Classification

The Service may classify medications or excipients using risk categories such as Safe, Ambiguous, or Not Safe. These classifications represent interpretations of available information and do not constitute guarantees of safety or risk. Individual patient responses may vary.

7. Beta Features

Certain features may be offered in beta or experimental form. Beta services may contain incomplete data, errors, or performance issues. Users acknowledge that beta functionality may change or be discontinued without notice.

8. Acceptable Use

Users agree not to:

  • Use the Service for unlawful purposes
  • Attempt to gain unauthorized access to system infrastructure
  • Interfere with system operation
  • Misrepresent the Service as their own product
  • Use automated scripts, bots, or scraping tools to access data

9. Intellectual Property Rights

AllergenMaps retains all rights, title, and interest in the Service and all associated intellectual property. This includes but is not limited to:

  • Database structures
  • Excipient risk classification systems
  • Data compilation methods
  • Platform architecture
  • Software code
  • User interface design
  • Search and filtering methodologies

The Service constitutes proprietary intellectual property and may not be copied, replicated, reverse engineered, or used to develop competing services.

10. Database Protection and Anti-Scraping Policy

The AllergenMaps database represents a substantial investment in data collection and organization.

Users may not:

  • Scrape or harvest database content
  • Systematically query the Service to reconstruct the database
  • Download or replicate large portions of the dataset

Attempts to circumvent technical protections may result in termination of access and legal action.

11. Limited License

Users are granted a limited, non-exclusive, non-transferable license to access the Service for personal, educational, or professional reference purposes.

This license does not permit:

  • Commercial redistribution
  • Database replication
  • Creation of derivative software or competing services

12. Confidentiality and Non-Disclosure

The Service contains confidential and proprietary information belonging to AllergenMaps, including proprietary data compilations, allergen and excipient classification methodologies, and trade secret information. By accessing the Service, you agree not to disclose, share, or publish such proprietary information to third parties without prior written consent from AllergenMaps.

This obligation does not restrict you from:

  • Reporting security vulnerabilities or software bugs to AllergenMaps or, where legally required or appropriate, to relevant authorities
  • Sharing general feedback, reviews, or user experience observations about the Service
  • Disclosing information that is already publicly available or independently known to you
  • Disclosing information as required by applicable law or court order

This obligation survives termination of your access to the Service.

13. User Feedback

Users may submit feedback or suggestions regarding the Service. By submitting feedback, users grant AllergenMaps the right to use such feedback without compensation or attribution.

14. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what limited information we collect (usage analytics, feedback submissions, survey responses, and API registration data), how it is used, and your choices. AllergenMaps does not sell personal data.

AllergenMaps is not a HIPAA Covered Entity or Business Associate. The Service does not collect or store Protected Health Information (PHI). Do not submit patient names, medical record numbers, or other PHI through the Service. Healthcare providers using the Service or API are solely responsible for compliance with applicable HIPAA obligations within their own systems.

15. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE." AllergenMaps makes no warranties, express or implied, regarding reliability, accuracy, or availability of the Service.

16. Limitation of Liability

To the fullest extent permitted by law, AllergenMaps and its creators shall not be liable for any damages resulting from use of the Service. This includes but is not limited to medical decisions, allergic reactions, data inaccuracies, or system downtime.

This limitation applies to all claims, whether brought by users directly or by third parties, arising from the Service or reliance on its data. Users are solely responsible for any third-party claims arising from their use of or reliance on the Service.

17. Indemnification

Users agree to indemnify and hold harmless AllergenMaps, its creators, employees, and affiliates from any claims, damages, or liabilities arising from misuse of the Service or violation of these Terms.

18. Termination of Access

AllergenMaps reserves the right to suspend or terminate access to the Service at any time for violations of these Terms or misuse of the platform.

19. Modifications to the Terms

AllergenMaps may update these Terms at any time. For material changes — such as changes to liability limitations, data practices, or intellectual property protections — we will provide reasonable advance notice by posting an updated "Last updated" date and a notice on this page at least 30 days before the changes take effect. For registered API key holders, we will also send advance notice to the email address associated with their API registration. Non-material clarifications (such as grammar corrections or clarifying language that does not alter rights or obligations) may take effect immediately upon posting. Continued use of the Service following the effective date of updates constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted under the laws of the State of Indiana, without regard to conflict of law provisions. Any legal action or proceeding not subject to arbitration under Section 22 shall be brought exclusively in the state or federal courts located in Indiana, and you hereby consent to personal jurisdiction and venue in such courts.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect. The invalidity of any one provision does not affect the validity of any other provision.

22. Dispute Resolution

Before initiating formal proceedings, the parties agree to attempt good-faith negotiation for at least 30 days by contacting legal@allergenmaps.com.

Except for claims seeking emergency injunctive relief or enforcement of intellectual property rights, any unresolved dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with one arbitrator, held in Indianapolis, Indiana. The arbitrator's decision is final and binding.

Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. Class action lawsuits and class arbitrations are not permitted under these Terms.

Opt-Out. You may opt out of arbitration for any individual claim by sending written notice to legal@allergenmaps.com within 30 days of first using the Service.
